'Harry Potter' fan testifies in trial and weeps

A Harry Potter fan who wants to publish an encyclopedic guide to the wildly popular fantasy novels broke down and cried on the witness stand Tuesday as he faced off in federal court against his idol J.K. Rowling.

The British author sued Steven Vander Ark's publisher RDR Books last year, claiming that their "Harry Potter Lexicon" — based on Vander Ark's fan Web site — infringed on her copyright.

Vander Ark wiped away tears when he was asked to reflect on what the case has done to his relationship with the community of Harry Potter fans. The former middle school librarian, who fell in love with the books in the late 1990s and has devoted years to studying them and indexing their content online, could barely speak.

"It's been ... it's been," he stammered, choking on his words. "It's been difficult because there has been a lot of criticism, obviously, and that was never the intention. ... This has been an important part of my life for the last nine years or so."

Vander Ark testified on the second day of a trial in U.S. District Court in Manhattan, pitting his publishing company, RDR Books, against Rowling and Warner Bros., the maker of the Harry Potter films and owner of all the intellectual property related to the Potter books and movies.

Rowling and the media company are trying to prevent publication of the "Harry Potter Lexicon," which Vander Ark and Michigan-based RDR had sought to publish last fall. Its release was delayed pending the outcome of the suit; Rowling has argued that the book borrows too heavily from her novels.

During his testimony on Tuesday, Vander Ark acknowledged that he, too, had substantial concerns all along about whether publishing an encyclopedia based on Rowling's Potter universe would constitute copyright infringement. He said he was talked into doing it by the publishing company.

Rowling (her name rhymes with bowling, rather than howling), testified Monday that the Harry Potter characters she created are as dear as her children, too precious to allow an inferior Potter encyclopedia to be published without letting the world know the ordeal is draining her of her will to write.

"I believe that it is sloppy, lazy and that it takes my work wholesale, verbatim. This book constitutes wholesale theft of 17 years of my hard work," she said of Vander Ark's effort.

She also said she recently started work on her own encyclopedia but does not expect to complete it for two to three years. If Vander Ark's lexicon is published, "I'm not at all convinced that I would have the will or the heart to continue with my encyclopedia," she said.

The case caused her to stop working on a new novel, as well, she told the packed courtroom.

"It's really decimated my creative work over the last month," she said. "Again, it's very hard to describe to someone who's not engaged in creative writing, but you lose the threads, you worry if you will be able to pick them up again in exactly the same way."

In his opening statement, RDR lawyer Anthony Falzone defended the lexicon as a reference guide, calling it a legitimate effort "to organize and discuss the complicated and very elaborate world of Harry Potter." The small publisher is not contesting that the lexicon infringes upon Rowling's copyright but argues that it is a fair use allowable by law for reference books.

The nonjury trial will be decided by U.S. District Judge Robert Patterson Jr., who must determine whether the use of the material is legal because Vander Ark added his own interpretation, creativity and analysis. The testimony and arguments could last most of the week.

The trial comes eight months after the publication of Rowling's final book in the series, "Harry Potter and the Deathly Hallows." The seven books have been published in 64 languages, sold more than 400 million copies and produced a film franchise that has pulled in $4.5 billion at the worldwide box office.

J.K. Rowling tells court she felt betrayed by rival's Harry Potter Lexicon

Harry Potter author J.K. Rowling told a Manhattan federal court today that a bid by a fan to print an unofficial encyclopedic companion to the boy wizard series left her unsure if she had 'the heart' to publish her own version.

Steve Vander Ark has written "The Harry Potter Lexicon," a 400-page reference book based on his popular fan Web site (www.hp-lexicon.org).

Rowling and Warner Bros. are suing RDR Books, which planned to publish the volume last November.

Rowling, 42, has said she plans to write her own Harry Potter encyclopedia, which would include material that did not make it into the novels, and donate the proceeds to charity. The novels have sold more than 400million copies.

"Mr Vander Ark has gutted that book," Rowling, who wrote seven Harry Potter novels, told a New York court.

"He has simply taken it and copied it ... It is sloppy, lazy and it takes my work wholesale."

"He's taken my creation ... I did feel an act of betrayal," said Rowling. She said she was not sure if she had "the will or the heart" to now publish her own encyclopedia.

She said the possibility that parents would part with their well earned cash to buy Vander Ark's book was "a travesty."

The lawsuit filed in October names independent U.S. publisher RDR Books and unidentified persons. It seeks to stop publication and requests damages for copyright and federal trademark infringement and any profits to be gained.

Warner Bros is a unit of Time Warner Inc, which owns the copyright and trademark rights to the Potter books.

"This is a case about the massive wholesale copying," Dale Cendali, a lawyer for Rowling and Warner Bros, told U.S. District Court Judge Robert Patterson in opening arguments.

"The lexicon is drawn almost entirely from Ms Rowling's work."

"This is not a case about money," she said, adding "the Harry Potter books encourage reading" and the lexicon "does not reflect well on the Harry Potter series."

Cendali said it was not a research guide as it lacked original material.

RDR Books has said Vander Ark, a librarian, had spoken at Harry Potter academic conferences in Britain, Canada and the United States and that a timeline he created was used by Warner Bros. in DVD releases of the Harry Potter films.

The company and Vander Ark have said the book would only promote the sale of Rowling's work and that Vander Ark's Web site, used by 25 million visitors, had been called "a great site" by Rowling herself.

"The lexicon is not a plausible substitute for any of the Harry Potter novels," said Anthony Falzone, a lawyer for RDR Books. "It's simply not plausible to argue that Ms Rowling's sales will be hurt in any meaningful way."

He said Vander Ark's Harry Potter interest began "as a labor of love" and his expertise was so sought after that Warner Bros flew him to the set of the fifth Harry Potter movie and used his lexicon everyday during production.

"It is, above all else, a reference guide," Falzone said. "Profit was never the point."

Who gave JK Rowling a helping hand on the night she had a cleavage malfunction?

Her necklines have been plunging lower and lower with each recent red carpet appearance.

And each time the likelihood that JK Rowling would suffer an embarrassing wardrobe malfunction has increased.

This week, however, after an evening where her decolletage frequently threatened to pop out, the situation was made worse by a rather hands-on aide.

As these pictures show, the publicist of the Harry Potter author launched himself forward to prevent photographers capturing the moment when the front of her purple gown slipped perilously south.

But amid the hubbub and with flashbulbs popping at the British Book Awards, Mark Hutchinson ended up with more of a handful than he planned for.

Asked last night about the incident, Mr Hutchinson, who has worked with Miss Rowling for more than five years, seemed confused about how he ended up in such a position.

Saying he did not clearly remember trying to protect Miss Rowling's modesty, he then gave two different accounts of how he might have ended up in such a position.

"Oh no, oh gosh!" remarked Mr Hutchinson, director of PR agency Colman Getty, when he heard of the unfortunate pictures.

"I think there was a point where there was a strap coming loose, and that was where my hands were going - on the top.

"To my knowledge I did not have my hand actually on her breast. Maybe it's the angle of the photograph."

The slip marked an embarrassing end to an evening when Miss Rowling had picked up a lifetime achievement award - but even so, observers were stunned by just how much she's transformed herself in the past decade.

The evening was a curious event where the worlds of literature and showbusiness met, with the likes of the Harry Potter author on one side and glamour-model turned children's author Jordan on the other.

Sir Richard Attenborough was seen giving Spice Girl Geri Halliwell a kiss on the cheek.

Elsewhere were model Marie Helvin, Dame Edna Comedian Barry Humphries and chef Gordon Ramsay, glamour girl Abi Titmuss and Strictly Come Dancing champ Alesha Dixon.

Jordan's outfit was a typically revealing bejewelled maxi-dress, complete with plunging neckline.

Khaled Hosseini took home the Richard & Judy Best Read of the Year for A Thousand Splendid Suns, and Russell Brand received a best biography Nibbie for his tell-all tome My Booky Wook.

A Nibbie for the best piece of non-fiction writing went to film star Ewan McGregor and acting pal Charley Boorman for Long Way Down, the account of their journey through Africa.

Row delays Harry Potter lexicon

A publisher has agreed to delay the release of a Harry Potter encyclopaedia after being sued by author JK Rowling.

Publisher Roger Rapoport said the book will not be published until a judge rules on whether it violates Rowling's intellectual property rights.

A judge in New York has issued an order barring completion, distribution, marketing or advance sales of the book until further notice.

Written by Steve Vander Ark, it was scheduled for release on 28 November.

Entitled Harry Potter Lexicon, it is based on material from an internet fan site of the same name.

Mr Rapoport, whose company is based in Michigan, said he had given a copy of the Lexicon to Warner Bros lawyers - who hold the copyright to the Harry Potter books - in the hope that they would read it and decide that it did not violate copyright.

"I think they should drop it. I'm hopeful that they will," he said.

'Massively disappointed'

Rowling's lawsuit, filed on 31 October, sought an injunction blocking publication of the book on the grounds that it would borrow too heavily from her work and spoil plans to eventually publish her own encyclopaedia of Harry Potter's world.

Rowling had supported the Lexicon website, but she and Warner Bros said they saw a difference between fans publishing information for free on the internet, and selling it in the form of a book.

Rowling said she took "no pleasure" in preventing the Lexicon's publication.

"On the contrary, I feel massively disappointed that this matter had to come to court at all," she said.

"Given my past good relations with the Lexicon fan site, I can only feel sad and disillusioned that this is where we have ended up."

Rowling completes post-Harry Potter book

LONDON - J.K. Rowling has completed her first book not to feature teen wizard Harry Potter an illustrated collection of magical fairy stories titled "The Tales of Beedle the Bard."

Only seven copies of the book are being printed, Rowling said Thursday. One will be auctioned next month to raise money for a children's charity, while the others have been given away as gifts.

Rowling drew the illustrations herself and provided the handwriting for the five stories that make up the collection of fairytales.

"The Tales of Beedle the Bard" is mentioned in the final Potter book, "Harry Potter and the Deathly Hallows," as a gift left by headmaster Albus Dumbledore to Harry's friend Hermione, and provides clues that help destroy evil Lord Voldemort.

"'The Tales of Beedle the Bard' is really a distillation of the themes found in the Harry Potter books, and writing it has been the most wonderful way to say goodbye to a world I have loved and lived in for 17 years," Rowling said in a statement.

The volume, bound in brown morocco leather and mounted with silver and semiprecious stones, will be auctioned at Sotheby's on Dec. 13 with a starting price of $62,000. Proceeds will go to The Children's Voice, a charity that helps vulnerable children across Europe.

"Deathly Hallows," the seventh and final installment in Harry's adventures, was published in July. The seven books have sold nearly 400 million copies and have been translated into 64 languages.

Rowling told the British Broadcasting Corp. that the book of fairytales had helped her say goodbye to Harry's world.

"It's not about Harry, Ron and Hermione, but it comes from that world," she told BBC radio in an interview broadcast Thursday. "So it's been therapeutic in a way."

Rowling said she was working on a new book, "a half-finished book for children that I think will probably be the next thing I publish."

On Wednesday, Rowling and the makers of the Harry Potter movies filed a lawsuit against RDR Books, a small U.S. publisher that plans to bring out a companion volume based on the Harry Potter Lexicon fan Web site.

Rowling has said she plans to produce her own encyclopedia of the wizarding world and says the book would infringe on her intellectual property rights.

Rowling publica primul volum din seria Harry Potter, carte ce fascineaza milioane de oameni de pe tot globul si care a devenit o industrie in sine.

De la lansarea primului volum, "Harry Potter si piatra filozofala", cartile au castigat o imensa popularitate si un succes comercial pe toate meridianele, batand orice record in materie de literatura pentru copii. Primele sase volume (intreaga serie va avea sapte volume) s-au vandut in peste 325 milioane copii si au fost traduse in peste 63 de limbi.

A saptea si ultima carte din seria Harry Potter, "Harry Potter si Ingerii Morti" este programat sa fie lansata pe data de 21 iulie 2007. Numai pentru piata americana, editorii au anuntat un record de 12 milioane de copii pentru prima tura de printare.

Lucru rar intalnit in acest tip de literatura, romanele au o poveste extrem de complicata, dar care nu te face sa uiti de ea pe noptiera, ci sa incerci sa deslusesti toate increngaturile, cu povesti de tradare, schimbari spectaculoase de situatie si veritabile investigatii.

Filmul „Harry Potter si Ordinul Phoenix” se pregateste de premiera

Lansari cu surprize se asteapta si la premiera filmului „Harry Potter si Ordinul Phoenix”, adaptarea celui de-al cincilea volum, pe 11 iulie. Productia a fost prezentat in avanpremiera mondiala in Japonia, joi, cu cateva saptamani inainte de lansarea ultimului volum al francizei.

Atentia producatorilor americani fata de publicul nipon nu este una intamplatoare, mai ales ca partea a patra a seriei, ""Harry Potter si Pocalul de Foc", a devenit lider al box office-ului nipon in 2006, cu incasari de 66 milioane de euro.

Super eroii se pregatesc de majorat

Daca in primul film, "Harry Potter si piatra filozofala", din 2001, Daniel Radcliffe, Emma Watson, Rupert Grint erau doar niste pusti, astazi, eroii fantastici, ajunsi la varsta adolescentei, sunt staruri planetare si le place distractia.

Daniel, care a jucat rolul baietelului-vrajitor, este acum un tanar de 17 ani, cu multe admiratoare, indragostit de ultimele tendinte din moda, in timp ce Emma, alias Hermione, s-a apucat de modelling si vrea sa studieze filozofia la Cambridge.

Al treilea erou, Rupert Grint, marturiseste, in schimb, ca adolescenta si trecerea de la ipostaza de copil-actor la cea de star au fost destul de complicate, insa statutul de vedeta nu l-a impiedicat sa se bucure de adolescenta, ca oricare tanar de varsta lui.

Vedetele din Harry Potter au acumulat si averi frumusele, Daniel asteptandu-si majoratul pe 23 iulie, pentru a intra in posesia averii de peste 20 de milioane de lire sterline. Cei trei se pregatesc intens pentru lansare si spera sa mai prinda cateva saptamani de vacanta in aceasta vara.

J.K. (Joanne Kathleen) Rowling was born in 1965 and grew up in Chepstow, Gwent. She left Chepstow to study French at Exeter University, where her course included a year in Paris. As a postgraduate, she moved to London to work at Amnesty International doing research into human rights abuses in Francophone Africa. She started writing Harry Potter after the idea occurred to her on an interminable Manchester to London train journey. Jo then moved to north Portugal to teach English as a foreign language, married, got pregnant, and kept writing. By the time her daughter was born, Harry Potter and the Philosopher's Stone was one-quarter finished.

Harry Potter and the Philosopher's Stone was published by Bloomsbury Children's Books in June 1997 to great critical acclaim, and has since won the Nestlé Smarties Book Prize Gold Medal (9—11 years), the FCBG Children's Book Award (overall winner), the Birmingham Cable Children's Book Award, the Young Telegraph Paperback of the Year, the British Book Awards' Children's Book of the Year and the Sheffield Children's Book Award, and was short-listed for the Guardian Fiction Award and the Carnegie Medal (received 'Commended'). The fifth book in the Harry Potter series, Harry Potter and the Order of the Phoenix, was published on June 21st 2003.

The Latin and Welsh translations of Harry Potter and the Philosopher's Stone were published by Bloomsbury in July 2003. The Irish Gaelic and Ancient Greek translations follow in the summer 2004, and the Scottish Gaelic translation at a date to be confirmed.

All four of the published Harry Potter novels by JK Rowling have been voted into the BBC Big Read's top 100, and Harry Potter and the Goblet of Fire has been voted into the top 21. The list was voted for by people in the UK. On December 21st, 2004, publishers announced that the sixth book, Harry Potter and the Half-Blood Prince, would be released on July 16th, 2005.

In timpul copilariei ei, parintii si-au schimbat locuinta de mai multe ori. Prima data s-au mutat in Winterbourne. Aici, Jo impreuna cu sora ei obisnuiau sa se joace cu niste vecini. Doi dintre ei erau frate si sora al caror nume de familie era Potter!

A doua oara parintii lui Jo s-au mutat in Tutshill, langa Chepstow, cand ea avea 9 ani si mai tarziu in Wyedean Comprehensive. Unul dintre cei mai buni prieteni aici este Sean Harris care o va inspira mai tarziu in crearea personajului Ron Weasley.

Va intrebati cine a inspirat-o in crearea personajului Hermione? Este chiar autoarea dupa cum marturiseste chiar ea! Majoritatea personajelor sunt inspirate de oameni pe care Jo i-a cunoscut in copilarie. Multe dintre nume sunt inventate sau sunt locuri din Anglia.

Dupa ce a absolvit scoala din Wyedean Comprehensive s-a inscris la Universitatea Exeter unde a studiat franceza. In timpul facultatii petrece un an in Paris si este asistent universitar. Dupa terminarea facultatii lucreaza in Manchester.

In 1991, la 26 de ani se muta in Portugalia unde preda engleza. Aici se intalneste si se casatoreste cu un reporter portughez si in 1993 naste o fetita, Jessica. La scurt timp dupa nasterea fetitei, divorteaza si se muta impreuna cu Jessica in Edinburg, Scotia, aproape de sora ei mai mica, Di. In aceasta perioada se hotaraste nu numai sa termine cartea despre micul vrajitor dar sa o si publice. Reuseste sa obtina de la Scottish Art Council o bursa pentru terminarea primei carti.

In acesta perioada, Jo nu duce o viata tocmai fericita. Castiga 105$ pe saptamana, locuieste intr-un apartament cu un singur dormitor si nu-si permite sa angajeze pe cineva care sa aiba grija de fiica ei. Scrie Harry Potter de mana pe caiete de notite in cafenelele din Edinburgh in timp ce fetita ei dormea in carucior pentru a salva banii pentru incalzirea apartamentului.

Dupa ce a terminat prima carte “Harry Potter si Piatra Filozofala”, care i-a fost respinsa spre publicare de mai multe ori, reuseste sa vanda drepturile de publicare editurii Bloomsbury in Anglia pentru suma de 4.000$. Ca sa se intretina pe ea si pe fiica ei, J.K. Rowling se angajeaza ca profesoara de franceza. Dupa cateva luni Scholastic Press cumpara drepturile de a publica in America acesta carte.

J.K. Rowling primeste suficienti bani ca sa renunte la postul de profesor de franceza si sa-si dedice tot timpul scrisului. Ea spune ca asta a fost cel mai fericit moment al vietii ei. Dupa ce Bloomsbury Children’s Books publica prima carte despre Harry Potter in 1997, a trecut foarte multa vreme pana cand J.K. Rowling sa fie considerata o mare descoperire.

In 1997 prima carte despre Harry Potter primeste Premiul Englezesc pentru Cea Mai Buna Carte Pentru Copii a anului si Smarties Prize.

La scurt timp dupa publicarea primei carti, J.K. Rowling termina de scris si cea de a doua carte, “Harry Potter si Camera Secretelor” care va fi publicata in Anglia in 1998 si in iunie 1999 in Statele Unite.

Imediat dupa succesul acestei a doua carti, in septembrie 1999, in Anglia si Statele Unite este terminata si publicata “Harry Potter si prizonierul de la Azkaban”. Spre uimirea si bucuria lui J.K. Rowling, cele 3 carti despre Harry Potter ocupa primele 3 locuri in lista celor mai bune carti publicate de New York Times. De asememnea, cartile au un mare succes si in Anglia.

Pana in vara anului 2000, J.K. Rowling castiga peste 400 de milioane de $ pentru primele 3 carti despre Harry Potter tiparite in 35 de limbi in peste 30 de milioane de exemplare.

A patra carte, “Harry Potter si Pocalul de Foc” s-a vandut chiar inainte de a fi publicata in peste un milion de exemplare. Prima publicare a acestei a patra carti a fost facuta in 5,3 milioane de exemplare. Datorita succesului cartilor despre Harry Potter in lista despre cele mai bune carti de literatura publicata de New York Times, s-a hotarat existenta de asemenea si a unei liste a celor mai bune carti de literatura pentru copii.

Nota noastra: In vara anului 2003, JK Rowlling a publicat "Harry Potter si Ordinul Phoenix", carte care s-a bucurat de un imens succes, batand toate recordurile de vanzari si comenzi. La inceputul anului trecut, ea a devenit mamica pentru a doua oara, dand nastere unui baietel, pe care l-a botezat David. In prezent lucreaza la a sasea carte.
Mai trebuie mentionat ca JK Rowlling este implicata in o serie de activitati de binefacere si de protectie a mediului inconjurator.
